Na oficina tem\u00e1tica da \u00faltima ter\u00e7a (22\/06), representantes d<\/span><span style=\"font-weight: 400;\">a Administra\u00e7\u00e3o Regional do JB explicaram o passo a passo a ser seguido.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><div class=\"su-youtube su-u-responsive-media-yes\"><iframe width=\"600\" height=\"400\" src=\"https:\/\/www.youtube.com\/embed\/lk9xQt-4pw4?\" frameborder=\"0\" allowfullscreen allow=\"autoplay; encrypted-media; picture-in-picture\" title=\"\"><\/iframe><\/div>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva, sans-serif;\"><b>MARCO REGULAT\u00d3RIO<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva, sans-serif;\"><span style=\"font-weight: 400;\">Em outubro de 2019, a Secretaria de Desenvolvimento Urbano e Habita\u00e7\u00e3o (SEDUH) publicou o decreto que regulamenta os artigos 151, 152 e 153 do C\u00f3digo de Obras e Edifica\u00e7\u00f5es do DF (COE). <\/span><span style=\"font-weight: 400;\">O COE foi institu\u00eddo pela Lei 6.138\/2018 e compreende duas etapas: Atestado de Habilita\u00e7\u00e3o de Regulariza\u00e7\u00e3o, que tem (validade de um ano), e a Carta de Habite-se de Regulariza\u00e7\u00e3o.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva, sans-serif;\"><span style=\"font-weight: 400;\">\u00c9 neste ponto que muitos se confundem. Os artigos que tratam da regulariza\u00e7\u00e3o s\u00e3o os seguintes: o 151, para as edifica\u00e7\u00f5es p\u00f3s normatiza\u00e7\u00e3o; o 152, para edifica\u00e7\u00f5es dentro das\u00a0 \u00c1reas de Interesse Social; e o 153, que trata da regulariza\u00e7\u00e3o das edifica\u00e7\u00f5es constitu\u00eddas antes do marco regulat\u00f3rio, ou seja, <\/span><span style=\"font-weight: 400;\">at\u00e9 26 de abril de 2018.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: trebuchet ms, geneva, sans-serif;\"><a href=\"https:\/\/www.mcjb.org.br\/portal\/wp-content\/uploads\/2021\/06\/Slide_de_Apresentacao_-_Carta_de_Habite_de_Regularizacao.pdf\">Slide_de_Apresenta\u00e7\u00e3o_-_Carta_de_Habite_de_Regulariza\u00e7\u00e3o <\/a>\u00a0&#8211; confira os slides apresentados pela Administra\u00e7\u00e3o Regional.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva, sans-serif;\"><i><span style=\"font-weight: 400;\">\u00a8Al\u00e9m de j\u00e1 ter aprovado o parcelamento do solo onde est\u00e1 a edifica\u00e7\u00e3o, \u00e9 muito importante estar atento a este marco\u00a8<\/span><\/i><span style=\"font-weight: 400;\">, explica o servidor da Administra\u00e7\u00e3o Allan Barradas. Uma das diferen\u00e7as estabelecidas pelo Artigo 153<\/span><span style=\"font-weight: 400;\"> \u00e9 que, c<\/span><span style=\"font-weight: 400;\">omo se tratam de unidades unifamiliares constru\u00eddas e ocupadas antes do marco regulat\u00f3rio, n\u00e3o h\u00e1 necessidade de apresenta\u00e7\u00e3o, por exemplo, da licen\u00e7a de obra ou alvar\u00e1 de constru\u00e7\u00e3o.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: 'trebuchet ms', geneva, sans-serif;\">Barradas tamb\u00e9m alertou para o fato de que, ap\u00f3s a regulariza\u00e7\u00e3o ser efetivada, modifica\u00e7\u00f5es no projeto arquitet\u00f4nico ser\u00e3o analisadas exclusivamente em conformidade ao rito de habilita\u00e7\u00e3o de projetos de arquitetura convencional. Isto diz respeito \u00e0 altura das edifica\u00e7\u00f5es, \u00e1reas perme\u00e1veis e demais par\u00e2metros urban\u00edsticos n\u00e3o atendidos no projeto original.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: 'trebuchet ms', geneva, sans-serif;\">Os documentos que o requerente ter\u00e1 que apresentar para a dar entrada na primeira fase, a de obten\u00e7\u00e3o do Atestado de Habilita\u00e7\u00e3o de Regulariza\u00e7\u00e3o, s\u00e3o:<\/span><\/p>\n<p><iframe src=\"https:\/\/www.mcjb.org.br\/portal\/wp-content\/uploads\/2021\/06\/Checklist_-_Habilitacao_-_Habite-se.pdf\" width=\"800px\" height=\"600px\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.mcjb.org.br\/portal\/wp-content\/uploads\/2021\/06\/Checklist_-_Habilitacao_-_Habite-se.pdf\">Checklist_-_Habilita\u00e7\u00e3o_-_Habite-se<\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: 'trebuchet ms', geneva, sans-serif;\">A comprova\u00e7\u00e3o de que a edifica\u00e7\u00e3o se deu antes da regulariza\u00e7\u00e3o urban\u00edstica pode ser feita com registros fotogr\u00e1ficos ou mesmo com aux\u00edlio do aplicativo Google Earth. A conclus\u00e3o da obra tamb\u00e9m deve ser comprovada.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva, sans-serif;\"><b>CARTA DE HABITE-SE DE REGULARIZA\u00c7\u00c3O\u00a0<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'trebuchet ms', geneva, sans-serif;\"><span style=\"font-weight: 400;\">Assim como no processo de habilita\u00e7\u00e3o, o requerente deve recolher a taxa de emiss\u00e3o da Carta de Habite-se e da taxa de expediente.
